TERMS AND CONDITIONS OF THE ONLINE STORE smartlights.pl

1. General provisions and contact

These Terms and Conditions (hereinafter “Terms”) set out the rules and conditions for using the online store smartlights.pl, operating at www.smartlights.pl (hereinafter “Store”).

The owner of the Store is Maciej Majchrzak, an entrepreneur operating under the business name Allocacoc Polska Check It Group Maciej Majchrzak, with its registered office at os. Pod Lipami 104/22, 61-640 Poznań, registered in CEIDG, VAT ID (NIP): 7792026058, REGON: 361836227 (hereinafter “Seller”).

Sales are generally conducted within the territory of the Republic of Poland; international deliveries are possible under the terms indicated in the Store.

2. Technical requirements

To use the Store you need: a device with Internet access, an up-to-date browser with JavaScript and cookies enabled, and an active e-mail address.

3. Product and pricing information

Information about products (descriptions and prices) constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.

Prices are given in PLN or EUR (gross, including VAT). The total cost of the order covers the price of goods and delivery and possibly payment costs — these are shown in the cart before placing the order.

In the event of a price reduction, we display the lowest price over the last 30 days before the discount (and for products offered for a shorter period — from the date of listing).

4. Conclusion of contract, Customer Account

Purchase is possible without registration or after creating an account (“Account”).

Order procedure: choose product → add to cart → choose delivery and payment → enter details → confirm with “Buy and Pay”. Confirming is placing an offer to purchase and accepting the obligation to pay.

A sales contract (“Contract”) is concluded when the Seller accepts the order for processing, which is notified by e-mail.

Confirmation of the Contract is provided on a durable medium no later than at the moment of delivery of the goods.

Registering an Account is voluntary and free; cancellation of the Account is possible at any time by contacting us via e-mail.

5. Payments

Available payment methods are shown in the cart and in the “Payment methods” section.

The Store may support payments via, among others: Stripe, BLIK, PayU, Przelewy24, Klarna, PayPal, as well as traditional bank transfer.

In the case of electronic payments, the operator is the selected payment platform; details are available on the operators’ pages.

6. Delivery and order fulfilment

Delivery methods: courier and InPost parcel lockers; any other methods according to the current offer in the cart.

Orders are typically shipped within 1 business day, unless otherwise indicated on the product page. Detailed rules and delivery costs are specified in “Delivery time and costs” section.

International shipments are handled according to the Store’s information or individually agreed terms.

7. Right of withdrawal (returns)

Consumer and business acting as consumer (under Article 7aa of the Consumer Rights Act) may withdraw from the Contract within 14 days from the date of receiving the goods, without giving a reason.

To meet the deadline, it is enough to send a withdrawal statement within the period: by e-mail info@smartlights.pl or by mail to Poznańska 5B, 62-081 Przeźmierowo, Poland. You may use the sample form (Annex 1), but it is not mandatory. Upon receipt, we will confirm the withdrawal by e-mail.

The returned goods must be sent to the above address within 14 days from the date of withdrawal statement; the cost of return is borne by the customer.

Refund (the purchase price + initial delivery cost up to the amount of the cheapest standard option) will be made promptly, but no later than within 14 days of receiving the withdrawal statement; we may withhold refund until the goods or proof of return is received.

The customer is liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, properties and functioning.

8. Exceptions to the right of withdrawal

  1. for non-prefabricated goods, made to the customer’s specification or personalized;
  2. for fast-perishing goods or goods with a short shelf life;
  3. for goods supplied in a sealed package which cannot be returned for health or hygiene reasons once unsealed;
  4. for audio/visual recordings or software delivered in sealed packaging once opened;
  5. for goods which, after delivery, become inseparably mixed with other items;
  6. for newspapers, periodicals or magazines (except for subscriptions);
  7. for goods whose price depends on fluctuations in a financial market independent of the Seller;
  8. for alcoholic beverages whose price was agreed upon at contract conclusion and whose delivery is possible after 30 days and depends on market changes.

9. Complaints (conformity of goods with the contract)

The Seller is liable to the consumer and business acting as consumer for any lack of conformity of goods existing at the time of delivery and revealed within 2 years.

If non-conformity occurs, the customer may demand repair or replacement; in cases allowed by law, they may declare a price reduction or withdraw from the contract.

A complaint can be lodged by e-mail at info@smartlights.pl or by letter to Poznańska 5B, 62-081 Przeźmierowo. We recommend including a description of the non-conformity, date when it was discovered, and the remedy sought.

We respond to complaints within 14 days.

10. Personal data

The data controller of personal data is the Seller.

Detailed information on data processing is available in the Privacy Policy published in the Store.

11. Reservations and changes to the Terms

The Store is not responsible for delays caused by incorrect data provided by the customer.

The Seller may suspend order fulfilment if there are justified doubts regarding the accuracy of customer data.

The Seller may change the Terms for valid reasons (e.g. changes in law, payment or delivery methods). Changes apply to orders placed after publication of the new version; for continuous services (e.g. Account) we will inform about changes and the right to terminate.

12. Out-of-court dispute resolution (ADR)

The consumer may use free assistance from the municipal or district consumer ombudsman or permanent consumer arbitration tribunals at the Trade Inspection.

Current info about ADR is available on the websites of the relevant national bodies. Note: the EU ODR platform was abolished in 2025.
